Letter from Seattle Police Department Chief of Police John A. Diaz #4497 to Mike O'Brien of Seattle City Council, dated March 15, 2013, suggesting changes to C.B. 117730, a bill regulating the acquisition and use of surveillance equipment by city staff. In the letter, Mr. Diaz requests that the bill include language exempting surveillance equipment from regulation if it will be installed or used on a temporary basis 1) for the purpose of a criminal investigation, 2) pursuant to a lawfully issued search warrant, or 3) under exigent circumstances as defined in case law. Mr. Diaz notes that courts are not inclined to grant warrants when warrants are not legally required, and suggests that an ordinance creating the legal requirement for police to obtain warrants will prevent them from performing surveillance.
